The NJ WorkAbility program offers the opportunity to receive full Medicaid coverage for people with disabilities who are working and whose income levels would otherwise make them ineligible for Medicaid.
On January 10, 2022, Governor Murphy signed into law S3445/A5262, which revised eligibility requirements for the NJ WorkAbility program. NJ Medicaid divided the necessary changes to be implemented in two phases.
Phase 1 changes to the revised NJ WorkAbility eligibility went into effect on April 1, 2023.
The changes that have gone into effect, as stated on the NJ WorkAbility webpage, are that NJ WorkAbility is now:
- "Open to all people over age 16 who have a disability determination
- Free from spousal deeming requirements
- Free from asset limits
- Available to enrolled members for 12 months after a job loss that happens through no fault of their own"
Phase 2 of the changes to NJ WorkAbility eligibility are expected to address issues regarding Social Security Disability Insurance (SSDI) funds disqualifying employees with disabilities from NJ WorkAbility. The Arc of New Jersey has reported that they anticipate Phase 2 implementation will take place later this year, although no date has been provided.
