DEA, HHS Extend Telehealth Flexibilities for Prescribing Controlled Medications through 2024

On May 1, 2023, the United States Drug Enforcement Administration (DEA), along with the Department of Health and Human Services (HHS), issued a temporary rule extending the allowance of the use of telemedicine for prescribing controlled medications in instances where the prescribing practitioners have never conducted in-person medical evaluations of the patients, extending certain exemptions granted to existing DEA regulations in March of 2020 as a result of the COVID-19 Public Health Emergency (PHE).

The first temporary rule extended the temporary exceptions until November 11, 2023.

Now, DEA and HHS have announced a second temporary rule, which will be published in the Federal Register tomorrow, October 10, 2023, extending such exceptions through December 31, 2024.
